Introduced by Sen. Vicki Schmidt (R) on January 21, 2010, in her role as a committee chair, to require a person who spends or contracts to spend $500 or more in a calendar year for any electioneering communication will be required to submit to the Kansas Governmental Ethics Commission a campaign finance report for each electioneering communication it conducts. The report would include: the name of the clearly identified candidate mentioned in the communication; the name, occupation and address of each individual that contributes more than $500 a year for an electioneering communication; the name and address of the vendor who is paid more than $500; and, the amount spent on or contracted to be spent on the electioneering communication. If the electioneering communication involves a candidate for statewide office, then the report would be submitted only to the Secretary of State. If the electioneering communication involves a local office, the report would be filed with the county election officer in the county in which the name of the candidate is on the ballot. The bill defines electioneering communication to mean any communication that reaches 500 or more people broadcast by television or radio, printed in a newspaper or on a billboard, directly mailed or delivered by hand to personal residences that unambiguously refers to any clearly identified candidate, is made available within 60 days of a general or primary election, and is intended for an audience of potential voters for that office.
